PREAMBLE
Unless otherwise specified, these General Terms and Conditions of Sale and the Legal Notice below apply to all browsing of the website www.jovoyparis.uk (hereinafter referred to as the "Website").
This Site refers to all pages and/or sites accessible at this address, including versions optimised for browsing via mobile or tablet.
It should be noted that these General Terms and Conditions of Sale and the Legal Notice below may vary depending on the country and/or region and/or country of origin of the products concerned.
The company JOVOY LIMITED (hereinafter referred to as the "Seller") sells perfumery products (hereinafter referred to as the "Products" or the "Product") presented on its website solely for retail sale and for strictly personal use by end consumers (hereinafter referred to as the "Consumers" or the "Consumer")..
Any order that clearly does not correspond to a retail sale or, more generally, any order that is fraudulent or suspected of being fraudulent will be considered by JOVOY LIMITED as null and void.
For the purposes of these terms and conditions, it is agreed that the Consumer and PARFETIQUE shall be collectively referred to as the "Parties" and individually referred to as the "Party".
By placing an order for a Product on the Website, the Consumer acknowledges that they have read and accepted these General Terms and Conditions of Sale without restriction. This acceptance is in no way conditional upon a handwritten signature by the Consumer.
It is specified that the Consumer may save or print these General Terms and Conditions of Sale, provided that they are not modified. The Seller reserves the right to update its General Terms and Conditions of Sale at any time, it being specified that the applicable General Terms and Conditions of Sale will be those in force on the date of the order.
The Consumer's consultation of the Website is also governed by the Website's Terms and Conditions of Use, which they accept without reservation.
ARTICLE 1: PURPOSE
The purpose of these general terms and conditions of sale (hereinafter referred to as the "GTC") is to define the terms and conditions of online sales by the Seller of Products to the Consumer, as well as the rights and obligations of the Parties arising from the online sale of the products offered on the Website (hereinafter referred to as the "Product(s)").
They determine all the steps necessary for placing an order and ensure the follow-up of this order between the Parties and apply, without restriction or reservation, to all Products offered by the Seller on its Website.
ARTICLE 2: THE PRODUCTS
2.1 Description of the Products
The Products offered for sale by the Seller are those appearing on the Website on the day the Consumer consults the Website, and are subject to availability.
JOVOY LIMITED also reserves the right to withdraw Products from sale at any time.
JOVOY LIMITED presents the Products for sale on the Website, along with detailed descriptions in product sheets. The Products are described with the greatest possible care and accuracy. However, the photographs and/or images on the Website are for illustrative purposes only and are not contractually binding.
For any questions relating to a Product or its use, it is therefore recommended that you contact the Seller's customer service department using the contact details provided in the following articles.
The Products comply with current British legislation. The Seller cannot be held liable for any failure to comply with the legislation of the country in which the Product is to be delivered. It is therefore the Consumer's responsibility to check with the local authorities regarding the possibilities of importing and/or using the Products they intend to order.
The Products are presented within the limits of available stocks and the Seller cannot guarantee the availability of the Products advertised on the Website.
JOVOY LIMITED reserves the right to modify or discontinue the Products offered on the Site at any time, without such modifications affecting orders that JOVOY LIMITED has accepted prior to the entry into force of such modifications.
In any event, in the event of total or partial unavailability of the Products after the order has been placed, the Consumer will be informed as soon as possible, by any means, of the unavailability of the Product and of the total or partial cancellation of the order.
In the event of total cancellation:
· The Consumer's order will be automatically cancelled and their bank account will not be debited;
· The Consumer will be informed by any means.
In the event of partial cancellation:
· The Consumer's order will only be partially validated and their bank account will only be debited for the amounts corresponding to the available Products:
· The rest of the order will be cancelled;
· The Consumer will be delivered the available products.
In any event, if the Consumer's order was eligible for free delivery, the fact that the minimum charge is no longer met shall not deprive the Consumer of this free delivery.
Article 3: Prices
3.1 All prices are indicated in Pounds (GBP). The applicable prices are those indicated on the Website at the time the Consumer places their order. These prices do not include certain additional costs such as transport costs, which will be charged in addition. The Consumer may also be required to pay mandatory taxes and duties as well as any bank charges, which will always be at their expense (for England, prices are indicated inclusive of VAT).
The Consumer acknowledges and accepts that product prices may vary between the Website and the JOVOY store, and that under no circumstances shall this price difference constitute grounds for a full or partial refund.
3.2 JOVOY LIMITED reserves the right to modify its prices at any time, without any formalities other than posting the changes on the Website. However, these changes will not affect orders that JOVOY LIMITED has accepted before the changes take effect, subject to the availability of the Products ordered.
3.3 These prices do not include shipping costs, which are charged to the Consumer in addition to the price of the Products purchased. Shipping costs will be indicated before the Consumer places the order.
3.4 Prices include Value Added Tax (VAT).
3.5 The various shipping methods are set out in Article 6 below and are listed on the Website; they may be modified at any time by JOVOY LIMITED. The Seller therefore advises Consumers to regularly consult the GTC available on the Website.
ARTICLE 4: ORDER
4.1 Ordering
By browsing the Website, the Consumer has the opportunity to view the Products offered for sale on the day of visiting the Website. Browsing the various pages of the Website does not commit the Consumer to placing an order.
During their browsing, Consumers who wish to place an order may do so by following these steps:
· Fill their virtual basket by clicking on the "Add to basket" icon next to each Product viewed.
Once this operation has been completed, the Consumer will see a message confirming that the item has been added to the basket, and the number of items in the basket will be displayed at the top right of the screen.
· Continue browsing by clicking on "Continue shopping" or click on "Proceed to Checkout" to view the items in the order, including the total amount (excluding shipping costs), the nature of the products ordered and their quantity.
The Consumer may return to this order, complete it, modify it or cancel it as long as it has not been confirmed. If the Consumer wishes to select other Products, they simply need to click on "Continue shopping", ensuring that the Product(s) they have just selected are still in the "Order" section.
· If the customer has a discount code, they can enter it in their virtual basket. The total amount of the order will then be automatically recalculated.
· Once the selection of Products is complete, the Consumer may confirm the order by clicking on "Proceed to checkout".
A new web page will then open, inviting the Consumer to
i) log in with their email address and password to place an order using their customer account, or
ii) place an order by creating a customer account.
The Consumer must then provide their contact details by accurately completing the form provided. They undertake to provide an address where delivery can be made during business hours, as well as their first name(s) and email address.
The Consumer may refer to JOVOY LIMITED’s "Privacy Policy" for more details on how JOVOY LIMITED collects and processes personal data. JOVOY LIMITED cannot be held liable for any inaccuracy in the information provided by the Consumer.
· Finally, the Consumer must choose the type of delivery desired (home delivery or in-store collection) and their payment method (credit cards, PayPal.). At the bottom of this page, an order summary will list all the information relating to this order, including the nature, quantity and price of the Products and the total amount of the order (including shipping costs).
· After reviewing the status of their order, the Consumer will be asked to:
- Either click on the "Proceed to checkout" button to proceed with the payment of their order, in accordance with the provisions of Article 4 of these T&Cs;
- Or click on the "pen" button in the navigation module at the top to modify the characteristics of their order and/or their personal details;
· By continuing, the Consumer must first read the GTC and then tick the box next to the message "I have read the general terms and conditions of sale and accept them without reservation".
Once these GTC have been accepted and the order confirmed, a payment page will open.
· The Consumer must then pay for their order using one of the payment methods offered by JOVOY LIMITED.
It is hereby reiterated that purchases made on the Website are reserved for private, non-professional customers for their own use, which is why JOVOY LIMITED only sells its products in quantities corresponding to the average needs of a household. JOVOY LIMITED reserves the right to refuse or cancel any order, prior to dispatch and for legitimate reasons, in particular where:
- The quantity of products or the total amount payable (for a single order or several cumulative orders) does not correspond to what is reasonably considered normal for household use;
- There is a reasonable indication that the purchaser is engaged in an economic or commercial activity in connection with the products ordered; or
- More generally, where the order appears abnormal or suspicious on reasonable grounds.
No contract is formed until we have accepted the order and dispatched the products. If an order is refused or cancelled in accordance with this Article, any payment already made will be refunded in full without undue delay.
JOVOY LIMITED shall in no event be held liable for the unavailability of the Website at the time of the order, for any reason whatsoever.
4.2. Order confirmation
4.2.1. Formation of the sale
Once the order has been confirmed and payment has been validated in accordance with the terms set out in Article 5 below (in the case of payment by credit card, provision of the credit card number, its expiry date and, where applicable, the security code), a printable and savable summary of the Consumer's order will be displayed, including the order references.
At this stage, the Consumer will no longer be able to modify their order.
Following confirmation of payment by the Consumer, the latter will receive an order confirmation email sent by JOVOY LIMITED. This email will contain the following information:
- The order number;
- The order summary;
- The order amount, including all taxes;
- The shipping costs;
- Payment confirmation;
- The terms and conditions for exercising the right of withdrawal, under the UK Consumer Contracts Regulations 2013 ; The terms and conditions relating to the delivery of the Product(s) ordered (estimated delivery time: thirty (30) days maximum from the date of order confirmation).
Only the consumer's receipt of the email confirming the order constitutes the sales contract.
4.2.2. Retention of title
JOVOY LIMITED retains full and complete ownership of the Product(s) ordered until full payment of the principal amount, including costs, taxes and mandatory contributions, has been received.
4.2.3. Refusal/cancellation of order
In order to protect JOVOY LIMITED from abusive or fraudulent practices, or practices that do not comply with the distribution networks it has set up, in the event that JOVOY LIMITED suspects any of these practices in connection with an order, it reserves the right to request additional documents from the Consumer (proof of address and debit in the Consumer's name, photocopy of the Consumer's identity card, photocopy of the Consumer's bank card, or other).
JOVOY LIMITED also reserves the right to refuse or cancel an order for a legitimate reason, including, but not limited to, when:
- the Consumer was able to place an order when the product(s) ordered had become unavailable in the meantime.
- a technical error occurs during the consumer's payment;
- there is an obvious error in the product description (for example, when there is an error in the essential characteristics of the product, or when a clearly incorrect price is displayed);
- JOVOY LIMITED detects or suspects fraudulent or abusive use of the customer account and/or related orders;
- JOVOY LIMITED suspects a breach of these T&Cs.
In this case, JOVOY LIMITED undertakes to inform the Consumer as soon as possible and to refund them as soon as possible.
Finally, in the absence of a response from the Consumer within fifteen (15) days of the request being sent by JOVOY LIMITED or for any other legitimate reason, the order will be automatically cancelled and JOVOY LIMITED will proceed as soon as possible to refund the order to the bank account debited at the time of the order.
4.3 Proof of order
In general, emails shall be deemed authentic between the Parties, in the same way as automatic recording systems on the Website, in particular with regard to the nature of the order.
The computerised records stored in the IT systems of JOVOY LIMITED and its partners shall be considered as proof of communications, orders and payments between the Parties.
The Consumer may access the electronic contract concluded between the Consumer and JOVOY LIMITED at any time, in accordance with the rules of common law. To do so, the Consumer shall contact Customer Services via the "contact" tab or by email at info.london@jovoyparis.com, providing all the necessary information, in particular the order number and their contact details.
ARTICLE 5: PAYMENT
5.1. Online payment must be made in Pounds, by credit card (VISA, MasterCard) or by other means of payment offered by JOVOY LIMITED (including PAYPAL).
The credit card is debited at the time of dispatch of the order.
Any bank charges shall be borne by the Consumer.
The following credit cards are accepted, Visa, MasterCard and American Express (AMEX). The credit card is debited when the order is shipped.
In general, the Consumer guarantees JOVOY LIMITED that they have the necessary authorisations to use the chosen method of payment at the time of order confirmation. If the bank refuses payment, the order will be automatically cancelled.
JOVOY LIMITED uses the Global Payments HPP payment platform.
5.2. JOVOY LIMITED also reserves the right to refuse any order or delivery that appears abnormal, in the event of a dispute with the Consumer, or, but not limited to, total or partial non-payment of a previous order by the Consumer.
5.3 Penalties equal to the legal interest rate may, at JOVOY LIMITED’s discretion, be applied automatically to unpaid amounts after a period of ten (10) days following the date of the Order or upon notification of the rejection of payment by the bank.
ARTICLE 6: DELIVERY
6.1. Delivery
When the Consumer is eligible for delivery, JOVOY LIMITED deliveries policies are listed at the following address: https://www.jovoyparis.uk/content/1-deliveries .
The Products ordered by the Consumer will be delivered to the postal address provided by the Consumer when placing their online order, by the postal services or by private carriers.
The Consumer may track the progress of their delivery on the Website by clicking on their customer account.
As delivery is provided by a third-party service provider, JOVOY LIMITED cannot be held liable if the non-performance or poor performance of this obligation is attributable to the Consumer, to the unforeseeable or insurmountable actions of a third party to the contract or to a case of force majeure.
The Consumer shall also bear the consequences (delayed delivery, inability to deliver, return of the Products to JOVOY LIMITED, additional transport costs) resulting, where applicable, from the incorrect and/or incomplete information provided by them for delivery and/or the absence of the Consumer at the time of delivery.
6.2. Delivery times
The Products will be shipped by regular postal services or carriers whose average delivery times are provided for information purposes on the DELIVERY page.
Sundays and public holidays are not considered working days.
In any event, the order will be fulfilled within a maximum of thirty (30) calendar days from the day following the day on which the Consumer placed their order, subject to full payment of the price.
6.3. Delayed delivery
If the maximum delivery time of thirty (30) days is exceeded and the Product(s) ordered have not yet been shipped, and if this delay is not due to force majeure, the Consumer may cancel their order by registered letter with acknowledgement of receipt sent to the following address:

Upon receipt of the Consumer's letter and if delivery has not been made in the meantime, JOVOY LIMITED will refund the amount debited from the bank account at the time of the order as soon as possible, excluding any other compensation.
In the event of partial delivery, the delivery may be made in several instalments, and the Consumer may only cancel their order for the balance not delivered.
Any delay in delivery must be reported as soon as possible by the Consumer by email to info.london@jovoyparis.com, so that JOVOY LIMITED can investigate with the postal services or the carrier. The Consumer must be informed that the duration of an investigation is uncertain, as JOVOY LIMITED has no control over it. If, during this investigation, the parcel is found, it will be immediately re-routed to the delivery address specified in the Consumer's order.
However, if at the end of this investigation it is confirmed that the parcel containing the Product(s) has been lost, JOVOY LIMITED shall, at its own expense, reship the Product(s) to the Consumer or, in the event of permanent unavailability, refund the Consumer for the sums collected to the bank account debited at the time of the order, in accordance with the terms and conditions of these general terms and conditions of sale.
6.4. Delivery made
Each delivery is deemed to have been made as soon as the Product(s) are made available to the Consumer by the carrier, as evidenced by the control system used by the carrier, such as the delivery tracking system.
In accordance with the applicable provisions of the Consumer Contracts, the Consumer will receive, upon delivery, an invoice detailing the price of the products ordered and, where applicable, the delivery costs charged to them, as well as a return form ( ) enabling them to exercise their right of withdrawal and obtain a refund for the products or exchange them.
It is the Consumer's responsibility to check the conformity and integrity of the Product(s) shipped immediately upon receipt.
In the event of delay, breakage or missing items, the Consumer must give accurate details of issues on the delivery note. In any event, the Consumer may only exercise their right of recourse against the carrier to whom they must make their complaints. Any complaints must be confirmed by registered letter to the carrier within three (3) working days of receipt, specifying the parcel number, the reasons for the complaint and, where applicable, enclosing a copy of the delivery note for the parcel.
Any reservations of this type must also be notified to the Customer Service Department of JOVOY LIMITED within the same time limit and in the same form at the following address:

A copy of the complaint sent to the carrier must be enclosed.
Any complaint made after this period or not in the required form will be rejected and JOVOY LIMITED will be released from any liability.
The Consumer must also ensure that the products delivered to them correspond to the order placed on the Website. In the event of non-compliance, the Consumer must inform JOVOY LIMITED at the above address and return the products to the address indicated and in accordance with the conditions set out in Article 7.
ARTICLE 7: RIGHT OF WITHDRAWAL
7.1 Withdrawal period
The Consumer has a legal period of fourteen (14) clear days from the date of receipt or collection of the products to exercise their right of withdrawal and request a refund for all or part of their order without having to provide any justification or pay any penalties.
If this fourteen (14) clear day period expires on a Saturday, Sunday or public holiday, it shall be extended until the next working day.
Consumers who have exercised their right of withdrawal must return the product(s) within the aforementioned period, in their original packaging and in good condition.
The Product(s) must be returned in their original packaging, unopened and in a condition that allows them to be resold as new.
Failing this, the Seller reserves the right to refuse to refund the product(s).
In accordance with UK Consumer Contracts Regulations 2013, the right of withdrawal cannot be exercised, unless otherwise agreed by the parties, for contracts for the supply of goods made to the consumer's specifications or clearly personalised.
The Consumer's attention is therefore drawn to the fact that the right of withdrawal does not apply to sales of products personalised at their request.
7.2 Refund conditions
In order to return their Product(s), the Consumer must contact JOVOY LIMITED at the following address within the legal time limit: info.london@jovoyparis.com.
In order to be refunded, the returned product(s) must be sent back by the Consumer to JOVOY LIMITED under the following conditions:
• new and unused;
• undamaged and in good condition;
• in their original packaging;
The package must be returned, securely sealed, within fourteen (14) working days of the Consumer exercising their right of withdrawal, to the following address:

Upon receipt of the package, JOVOY LIMITED will assess the condition of the returned goods and send a confirmation email, if applicable.
After the aforementioned fourteen (14) day period, JOVOY LIMITED reserves the right to refuse the return requested by the Consumer.
No returns will be accepted if the returned products have been visibly used or damaged by the Consumer and/or a third party and this use or damage renders the products unsuitable for sale.
Furthermore, the Consumer has a period of thirty (30) working days from the date of delivery of their parcel to make any complaint regarding the return of said parcel. No disputes will be accepted after this period.
The Consumer must send their complaint by registered letter with acknowledgement of receipt to the following address:

In the event of a return due to a defective product, Jovoy will organise a collection free of charge to the customer’s address to pick up the damaged product.
Otherwise, the shipping costs will be borne by the Consumer, who will assume all responsibility in the event of loss, theft or damage to the packages and/or products during transport, without being entitled to any refund from JOVOY LIMITED.
In the event of return by any means other than those offered by JOVOY LIMITED, the parcel will be sent to the above address.
7.3 Refund
In the event of a request for a refund, JOVOY LIMITED undertakes to refund the returned Products under the conditions set out in Regulation 34, Consumer Contracts Regulations 2013, by crediting the Consumer's bank account corresponding to the bank card used for payment, by bank transfer to the account details provided to JOVOY LIMITED by the Consumer, or via PayPal.
ARTICLE 8: PRODUCT COMPLIANCE AND WARRANTY
The Product(s) are subject to the conditions and warranties provided for by UK law.
Thus, the Products offered by the Seller on the Website are subject to the statutory warranty conditions provided under the Consumer Rights Act 2015, in particular Sections 9, 10, 11, 13, 19 and 24, and other applicable consumer legislation:
- Section 9 of the Consumer Rights Act 2015 – Goods to be of satisfactory quality:
"Every contract to supply goods is to be treated as including a term that the quality of the goods is satisfactory." - Section 10 – Goods to be fit for particular purpose:
"If the consumer makes known to the trader any particular purpose for which the goods are being bought, there is an implied term that the goods are reasonably fit for that purpose." - Section 11 – Goods to be as described:
"Every contract to supply goods by description is to be treated as including a term that the goods will match the description." - Section 13 – Goods to match a sample or model:
"If a sample or model of goods is shown or examined by the consumer, the goods supplied must match the quality of that sample or model." - Section 19 – Consumer’s rights to enforce terms about goods:
"The consumer may be entitled to a repair, replacement, price reduction or final right to reject the goods if they fail to conform to the contract." - Section 24 – Right to price reduction or final right to reject:
"If repair or replacement is not possible, or not carried out within a reasonable time, or causes significant inconvenience to the consumer, the consumer has the right to a price reduction or may reject the goods."
These legal rights apply as follows:
- Any lack of conformity that becomes apparent within six months of delivery is presumed to have existed at the time of delivery, unless the Seller proves otherwise.
- The consumer has a right to reject the goods within 30 days of delivery for a full refund if they do not conform.
- After 30 days and within six months, the consumer may request repair or replacement. If unsuccessful, a partial or full refund may be requested.
- Claims for defective goods may be brought for up to six years after delivery in England and Wales (five years in Scotland), provided the defect was present at the time of delivery.
These legal guarantees apply independently of any commercial warranty.
It is further specified that the legal guarantees do not apply in cases of normal wear and tear of the Products, failure to follow care or maintenance instructions, or damage caused by external factors beyond the Seller's control.
Similarly, JOVOY LIMITED cannot be held liable for the misuse and/or intensive use of the products by the Consumer.
The Consumer has a period of three (3) days from delivery to make any reservations or complaints regarding non-compliance or apparent defects in the Products delivered, by email to the following address:info.london@jovoyparis.com , or by registered letter with acknowledgement of receipt to the following address:

The Customer Service Department will then inform the Consumer of the procedure to follow.
The Products must be returned in their original packaging with a copy of the invoice.
JOVOY LIMITED will not accept parcels sent carriage forward.
Any risk associated with returning the Product(s) is the responsibility of the Consumer.
Upon receipt of the Product(s) presumed to be non-compliant, JOVOY LIMITED will inspect the Product(s) as soon as possible. If the non-conformity of the Product(s) is confirmed, JOVOY LIMITED will then refund the non-compliant Product(s) to the bank account debited at the time of the order within thirty (30) days of receipt of the non-compliant Product(s) and the initial delivery costs.
ARTICLE 9: INTELLECTUAL PROPERTY
The Website, its content (text, comments, illustrations, images, logos, database, trademarks, source code, etc.) and all intellectual property rights attached thereto, as well as all intellectual property rights relating to the Products sold on the Website and their packaging, and all industrial property rights held by JOVOY LIMITED (hereinafter collectively referred to as "Intellectual Property") are the exclusive property of the Seller.
Any reproduction, representation, distribution, modification or use of all or part of the Intellectual Property, by any means whatsoever and on any medium whatsoever, without the prior, written and express authorisation of JOVOY LIMITED is strictly prohibited and may result in legal proceedings, except as provided for in the Intellectual Property Code.
ARTICLE 10: PROTECTION OF PERSONAL DATA
In the context of the Consumer's use of the Website, JOVOY LIMITED is required to process and collect personal data.
The privacy policy, available at the following address: https://www.jovoyparis.uk/content/4-personnal-date-cookies- , forms an integral part of these General Terms and Conditions of Sale; it provides information on how JOVOY LIMITED collects and processes personal data.

ARTICLE 11 – MISCELLANEOUS
11.1 Non-waiver
The fact that JOVOY LIMITED refrains from demanding the fulfilment of any of the provisions of these General Terms and Conditions of Sale at a given time cannot be interpreted as a waiver of the right to invoke said total or partial non-fulfilment at a later date or to invoke said provision in the future.
11.2 Validity of the general terms and conditions of sale
If any provision of these General Terms and Conditions of Sale is declared invalid in whole or in part, the other provisions and the other rights and obligations arising from these General Terms and Conditions of Sale shall remain unchanged and shall continue to apply.
11.3. Modification of the contract
Any amendment or waiver of any of the clauses of the General Terms and Conditions of Sale by JOVOY LIMITED shall apply from the date of their publication on the Website.
Any previous order shall remain subject to the General Terms and Conditions of Sale in force on the date of the order.
11.4. Applicable Law – Disputes
These General Terms and Conditions of Sale are governed by and shall be construed in accordance with the laws of England and Wales.
In the event of any dispute arising out of or in connection with the interpretation, performance, or termination of these General Terms and Conditions of Sale, the parties agree to first attempt to resolve the matter amicably. The Customer must submit a written complaint, clearly outlining the nature and grounds of the dispute, by recorded delivery to the following address within ten (10) days of the issue arising:

If no amicable resolution is reached within thirty (30) days of receipt of the complaint, either party may refer the dispute to the courts of England and Wales, which shall have exclusive jurisdiction.
In accordance with the Alternative Dispute Resolution for Consumer Disputes (Competent Authorities and Information) Regulations 2015, consumers may be entitled to refer unresolved complaints to an independent alternative dispute resolution (ADR) entity. While the use of ADR is not mandatory, JOVOY LIMITED will consider such referrals in good faith.
This clause does not affect the Customer’s statutory rights under the Consumer Rights Act 2015 or any other applicable consumer legislation.
